Global Sales Tax vs. Hong Kong Profit Tax: A Guide for E-commerce Sellers

One of the most confusing aspects of running a global e-commerce business through a Hong Kong company is untangling the web of international taxation.

Many overseas entrepreneurs believe that if they secure the 0% Hong Kong Offshore Profit Tax Exemption, they are entirely free from all taxes worldwide. This is a dangerous misunderstanding of the difference between direct corporate tax and indirect consumer tax.

This guide clarifies how foreign sales taxes interact with your Hong Kong corporate structure.

Direct Tax vs. Indirect Tax

To manage your global compliance, you must separate your tax obligations into two distinct categories:

  1. Direct Tax (Profit Tax)

This is a tax on your company's net income (Revenue minus Expenses). Because your company is registered in Hong Kong, it is subject to the Hong Kong Inland Revenue Department (IRD). If your operations meet the offshore criteria, you legally pay 0% corporate profit tax.

  2. Indirect Tax (Sales Tax / VAT / GST)

This is a consumption tax charged on the final sale of a product. It is paid by the consumer, collected by you (the merchant), and remitted to the government where the consumer lives.

Hong Kong is a free port and does not have any VAT, GST, or Sales Tax. However, if your Hong Kong company sells goods to customers in the United States or Europe, you are subject to the tax laws of those specific jurisdictions.

Navigating US Nexus and EU OSS

If you store inventory in an Amazon FBA warehouse in Texas, you have established "physical nexus" in that state. Your Hong Kong company is legally required to register for a Texas Sales Tax permit, collect sales tax from Texan buyers, and remit it to the state comptroller.

Similarly, if you sell to customers in the European Union, your Hong Kong company must register for the Import One-Stop Shop (IOSS) or a standard VAT number to collect and remit European VAT.

How Foreign Taxes Help Your Offshore Claim

A common concern is that registering for a US Sales Tax permit or an EU VAT number will compromise the Hong Kong company's offshore tax status. In reality, it does the exact opposite.

When your Chartered Tax Adviser (CTA) submits your offshore claim to the IRD, the assessor requires proof that your sales took place overseas. Providing documentation that your Hong Kong company is actively registered for, and paying, US Sales Tax or EU VAT is ironclad, government-backed evidence that your core economic market and customer base exist entirely outside of Hong Kong.

By understanding that global indirect taxes are simply a cost of doing business, you can confidently manage your international compliance while protecting your 0% corporate profit tax at the Hong Kong level.
